RETURNS
Introduction
In certain circumstances we offer a full refund on goods returned to us within the appropriate timescale and in accordance with this policy.
There are different criteria and different time-periods within which you can return goods depending on whether the goods were purchased “On-Premises” or it was a “Distance Purchase”. See below for further details.
This policy is in addition to your statutory rights. Customer’s statutory rights are not affected by this policy. This will include those defined under the Sale of Goods Act 1979 and later amendments, among other enacted laws.
On-Premises Purchases
4. An “On-Premises Purchase” is one where the purchase takes place at Erin Cox Jewellery, 56 Fore Street, Topsham, EX3 0HW at which you are physically present at the time purchase.
5. With regard to On-Premises purchases we offer the following rights of return in addition to your statutory rights:
5.1 Unwanted goods may be returned within 28 days for a credit note or exchange if they are returned unused and in their original condition. Returns must be made with proof of purchase. With regards to On-Premises Purchases there are certain goods to which the right to return do not apply and these are set out in clause 6.
5.2 For goods purchased On-Premises you are obliged to return the goods to the premises at which you purchased them.
5.3 We will inspect all goods upon return. If through your handling the goods have decreased in value, we may decline to accept the return of the goods and to issue a refund [or may, at our discretion, deduct a reasonable amount of such loss from the amount reimbursed to you].
6. Products which cannot be returned:
Commissioned or ‘Made to Order’ items.
Modified, customised or resized jewellery.
Jewellery returned in an unacceptable condition that would not allow for the item to be re-sold.
6.1 These products can only be returned in accordance with your statutory rights.
7. On-Premises Refunds will be issued in the form of a credit note which may be used to purchase alternative goods from us and which will be valid for (12) months from the date of issue.
8. Refunds and exchanges on purchases made on an event day or with other promotional discount will be calculated at the reduced price.
9. Your statutory rights are not affected.
Distance Purchases
10. With regard to Distance Purchases / online purchases you have cancellation rights under the Rights of Cancellation (Consumer Contracts Regulations 2013) (“the Regulations”).
11. When it comes to Distance Purchases the Regulations define “Distance Selling” as a contract concluded between a trader and a consumer under an organised distance sales or service-provision scheme without the simultaneous physical presence of the trader and the consumer, with the exclusive use of one or more means of distance communication up to and including the time at which the purchase is concluded. This is what is meant by a “Distance Purchase” in this policy.
12. With regard to Distance Purchases under the Regulations you have the legal right to cancel your order up to 14 calendar days after the day on which you receive your goods, with the exception of goods mentioned in clause 6 above. You do not need to give us any reason for cancelling your contract nor will you have to pay any penalty.
13. Should you wish to cancel your order, you must notify us within the 14 day cooling period by email (info@erincox.co.uk) or phone (01392 660836) & you have another 14 days to return the goods at your own cost and risk, unworn and in the original packaging.
14. Once you have notified us that you are cancelling your purchase, and we have received the goods back in the original condition, we will arrange a refund to your original payment method as soon as possible or within 14 calendar days.
15. We may make a deduction from your refund for any loss in the value of the goods supplied if the loss is the result of unnecessary handling by you (for example using or wearing the goods prior to cancellation).
16. Once the products are returned to us, you will receive a full refund. You will be liable to arrange and cover the full cost of returning the order to us.

18. To exercise your right to cancel, please contact us please email info@erincox.co.uk or call 01392 660836. Please ensure that you state clearly that you wish to cancel, providing your order number, your contact details and details of the products you wish to cancel.
19. On return of the goods, we will process your refund as soon as possible, but please note that, depending on your bank/card issuer, it may take up several working days for your refund to appear in your account.
20. This policy may be changed from time to time at our discretion.
